(“Fruit Street,” “we,” “our,” and/or “us”) values the privacy of individuals who use our mobile application, website, and related services (collectively, our “Services”). This Privacy Policy explains how we collect, use, disclose, retain, and otherwise process information from users of our Services (“Users”).By using our Services, you acknowledge the practices described in this Privacy Policy. Where applicable law requires affirmative consent for a particular collection, use, or disclosure of personal information, we will request that consent before engaging in that activity. Your use of our Services is also subject to our Terms of Service.All protected health information maintained by Fruit Street that is subject to the Health Insurance Portability and Accountability Act (“HIPAA”) is governed by Fruit Street’s Notice of Privacy Practices. The Notice of Privacy Practices may contain additional provisions relating to the use and disclosure of protected health information that go beyond this Privacy Policy.Information We CollectWe may collect a variety of information from or about you or your devices from various sources, as described below.A. Information You Provide to UsAccount Creation.When you sign up for an account, we may ask you for your name, phone number, and email address.Prediabetes Risk Test.When you take our “Risk Test,” we may ask for information necessary to assign you a prediabetes risk score. This may include your age range, family history of diabetes, history of high blood pressure, race or ethnicity, physical activity level, sex, height, and weight range.Registration.To complete registration for the Services, we may ask for additional information about you, including your physical mailing address.Blood Test.In order for certain Services to be covered by Medicare, Medicaid, a health insurer, or another third-party payor, you may need to provide us with a copy of a blood test containing information required by the applicable program or payor.Physical Activity Log, Food Log, and Goals.You may manually log physical activity, take pictures of and track food you eat, and set and track custom goals through the Services. We collect the information you choose to provide.Communications.If you contact us directly, we may receive information such as your name, phone number, email address, the contents of your message, attachments, and other information you choose to provide. When we send emails, we may use technologies that help us understand whether messages are delivered, opened, or interacted with, subject to applicable law and the limitations described in this Privacy Policy.Careers.If you apply for a job with us, we may collect contact information, resume information, education and employment history, and other information you choose to provide. If you apply through a third-party service, such as LinkedIn, we may collect information you make available to us through that service.Health Insurance and Payment Information.If you make a payment through our Services, payment-related information, such as credit card or other financial information, is collected by our third-party payment processor on our behalf. If our Services are covered by health insurance or another third-party payor, we may collect information such as your health plan name, subscriber ID, eligibility information, and claims-related information.B. Information We Collect When You Use Our ServicesWeight.We may collect your weight through an enabled wireless scale so that you and your care team can track progress over time.Device Information.We may receive information about the device and software you use to access our Services, including IP address, general location derived from IP address, device type, device identifiers, browser type and version, operating system version, phone carrier and manufacturer, application information, mobile advertising identifiers where permitted, and push notification tokens.Usage Information.We may automatically receive information about your interactions with the Services, such as pages or content viewed, referrer information, and dates and times of visits.Diabetes Prevention Classes.We offer online diabetes prevention classes with lifestyle coaches and other Users. We collect information you choose to provide during those classes. Information you voluntarily share with other class participants may be visible to those participants, and Fruit Street cannot control how another participant handles information you choose to disclose to them.Cookies, Analytics, and Similar Technologies.We use cookies and similar technologies that are reasonably necessary to operate, secure, maintain, and improve our Services. We may also use analytics technologies to understand how the Services are used and to improve functionality.Fruit Street does not use Meta Pixel, Google advertising pixels, or similar third-party advertising tracking technologies to disclose personal health information or individually identifiable health information to advertising networks.We currently use PostHog to assist with product analytics. We configure our analytics practices to limit information disclosed to analytics providers and, where required by applicable law, enter into appropriate contractual protections with service providers.We do not disclose personal health information to third-party advertising platforms for targeted advertising without first obtaining any affirmative express consent required by applicable law. Where applicable law requires consent before a non-essential tracking technology is activated, we will obtain that consent before activating the technology.Information collected through analytics technologies is used to operate, secure, evaluate, and improve the Services and is not authorized for use by third parties to build advertising profiles based on a User’s personal health information.Consent and Use of Health InformationWe collect information that is reasonably necessary to provide and administer the Services, determine eligibility for our programs, support Users participating in health programs, communicate with Users, process payments and insurance claims, satisfy regulatory and program requirements, maintain the security of the Services, and improve our products and services.Where applicable law requires affirmative consent for a particular collection, use, or disclosure of personal information, we will request that consent before engaging in that activity. A consent request will describe the information involved and the purpose for which it will be used or disclosed.We do not condition participation in our Services on consent to an unrelated use or disclosure of personal health information for targeted advertising.We do not sell personal health information or disclose personal health information to third parties in exchange for monetary consideration.We may create and use aggregated or de-identified information that cannot reasonably be used to identify an individual for lawful purposes, including quality improvement, analytics, research, regulatory reporting, and evaluation of program and clinical outcomes.How We Use the Information We CollectWe may use the information we collect:• To provide, maintain, improve, and enhance our Services;

• To facilitate connections with third-party services or applications, such as health tracking apps and services, when requested or authorized by you;
• To provide information about Fruit Street programs, products, and services that may be of interest to you, subject to applicable consent and opt-out requirements;
• To generate aggregated or de-identified data that we may use for lawful purposes, including reporting program or clinical outcomes to organizations such as the Centers for Disease Control and Prevention (“CDC”) and Centers for Medicare & Medicaid Services (“CMS”);
• To send text messages and push notifications in accordance with applicable consent requirements;
• To facilitate transactions and payments;
• To detect and prevent fraud, abuse, security incidents, and other trust and safety issues;
• To comply with legal and regulatory obligations, enforce our Terms of Service and other legal rights, and respond to lawful judicial or governmental requests; and
• For other purposes for which we provide specific notice at the time information is collected.We do not use personal health information, including information concerning a health condition, diagnosis, treatment, laboratory result, weight, medication, or participation in a health program, for third-party targeted advertising without obtaining any affirmative express consent required by applicable law.How We Disclose the Information We CollectVendors and Service Providers.We disclose personal information to vendors and service providers only as reasonably necessary for them to perform services on our behalf, such as hosting, communications, analytics, payment processing, customer support, security, and healthcare-related services.We require service providers to process information in accordance with applicable contractual and legal restrictions. Where a service provider creates, receives, maintains, or transmits protected health information on our behalf and HIPAA requires a business associate agreement, we enter into an appropriate business associate agreement.Service providers are not authorized to use personal health information received from Fruit Street for their own targeted advertising purposes unless the User has provided any affirmative express consent required by applicable law.Analytics Providers.We use analytics providers, including PostHog, to help us understand the operation and use of our Services. We limit the information provided to analytics providers based on the services they perform for us and implement contractual and technical safeguards appropriate to the information involved.We do not authorize analytics providers to use personal health information obtained from Fruit Street for their own advertising purposes.Advertising and Marketing.Fruit Street may advertise its Services through third-party advertising platforms. However, we do not provide those advertising platforms with personal health information or individually identifiable health information for targeted advertising without first obtaining any affirmative express consent required by applicable law.We may use limited information that is not personal health information for marketing purposes where permitted by law. We do not authorize advertising partners to use information obtained from Fruit Street to infer a User’s medical condition, diagnosis, treatment, laboratory result, participation in a health program, or other sensitive health characteristics for targeted advertising.Where we request consent for a use or disclosure of health information for advertising or another purpose requiring affirmative express consent, we will clearly describe the information involved, the purpose of the use or disclosure, and the third party or categories of third parties receiving the information. Declining such consent will not affect access to portions of the Services for which the disclosure is not necessary.As Required by Law and Similar Disclosures.We may access, preserve, and disclose information if we believe doing so is required or appropriate to comply with law enforcement requests, legal process, court orders or subpoenas; respond to your requests; protect the rights, property, safety, or security of you, Fruit Street, or others; or satisfy other legal obligations.Merger, Sale, or Other Asset Transfers.We may transfer information to service providers, advisors, potential transaction partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction involving a merger, acquisition, financing, reorganization, bankruptcy, sale, liquidation, or transfer of all or a portion of our assets. We do not receive payment from advertising networks, data brokers, or similar third parties in exchange for providing them with identifiable information concerning a User’s health, medical condition, diagnosis, treatment, laboratory results, weight, insurance information, participation in a health program, or other personal health information.Fruit Street may generate aggregated or de-identified information that cannot reasonably be used to identify an individual. We may use that information for lawful purposes, including measuring program performance, improving our Services, research, regulatory reporting, and reporting outcomes to organizations such as the CDC and CMS.Your ChoicesMarketing Communications.You may unsubscribe from promotional emails through the unsubscribe link contained in those emails. Even if you opt out of promotional emails, you may continue to receive administrative, transactional, or service-related messages.If you provide your mobile phone number and affirmatively opt in to receive marketing text messages from Fruit Street, you consent to receive promotional SMS messages related to our programs, services, and offerings. Retention periods vary depending on the nature of the information and the purpose for which it was collected.Account and Profile Information.Information such as your name, email address, date of birth, and contact details is retained for as long as your account remains active. If you close your account, we delete or de-identify this information except where retention is required or permitted for the purposes described below.Health and Wellness Information.Information you record or connect to the Services, including weight and body measurements, blood pressure readings, activity, steps, workouts, hydration, meal and progress photos, laboratory or blood test images, and goals, is retained for as long as your account remains active so that you and your care team can view your history. Because we operate structured health programs, we may retain participant health records after an account is closed for as long as required by applicable health record retention laws and program requirements.Information from Connected Devices and Services.Information received from a connected scale, Apple Health, Health Connect, connected health record provider, or similar service is retained on the same basis as other health information. If you disconnect a device or service, we stop receiving new data from it; data already synchronized is retained as described in this Privacy Policy.Messages and Communications.Messages with coaches, care team members, and other program participants, including attachments, are retained for as long as your account remains active and afterward where they form part of the record of care or must otherwise be retained by law.Insurance, Eligibility, and Claims Information.We retain insurance, eligibility, and claims information for the period required by applicable insurance, healthcare, billing, and recordkeeping laws.Payment Information.Payment information is processed by our payment provider. Fruit Street does not store full payment card numbers. We retain transaction records as required for tax, accounting, audit, fraud prevention, and legal purposes.Technical, Analytics, and Diagnostic Information.Device information, app usage events, and server logs are retained in identifiable form only for as long as reasonably necessary to operate, secure, troubleshoot, and improve the Services, after which they are deleted, de-identified, or aggregated where appropriate.We may retain information for longer where required by law, where needed to establish, exercise, or defend legal claims, resolve disputes, investigate security incidents, or prevent fraud or abuse. We may retain aggregated or de-identified information that cannot reasonably be used to identify you without the limitations described above.Closing Your Account and Requesting Deletion.You may ask us to close your account and delete personal information associated with it at any time through the mobile app under Profile → Settings → Delete My Account, or by emailing start@fruitstreetclinic.com. Where we cannot delete information, we will limit its use to the purpose that requires or permits us to retain it.Children’s PrivacyWe do not knowingly collect, maintain, or use personal information from children under 18 years of age, and our Services are not directed to children.
